Elevator malfunction

  • This case was referred to us by a Dallas attorney. The client was attending a seminar at a large hotel in Dallas. She got on an elevator and descended to a lower floor. The door opened. Just as the client stepped off the elevator dropped about twelve inches, causing her to stumble. She required two arthroscopic surgery procedures, one to the shoulder and one to the knee. We filed suit against the hotel and the company that manufactured, installed and maintained the elevator. We found and engaged an expert witness whose inspection established the cause of the failure. We proved by written discovery and oral depositions that the defendants had actual knowledge of the defect but neither repaired the elevator nor removed it from service.

  • Our client, a 55 year old long term employee of Wal-Mart, was shopping at a large grocery store on Garland Road. She parked her car in the paved parking lot, got out and walked toward the store entrance. She stepped in a hole in the pavement about eight inches across, fell and broke her leg. She did not see the hole because her attention was focused on an approaching automobile. The hole appeared to have been present for a long time, as did other holes in the parking lot, evidencing failure to inspect and repair.

  • Case referred to us by a personal injury attorney in Seattle. The client was a Seattle resident, formerly a varsity basketball player for the University of Washington. He was an FAA flight inspector visiting in Arlington while investigating an aircraft accident at DFW airport. He slipped on wet algae on an unused sidewalk that appeared to him to lead to the main front entrance to the restaurant. Aggravation of prior operated knee condition necessitating three more surgeries.
